PROMOTION AFTER RETIREMENT

Retired government employees who missed out on their promotions due to late meetings of the committees deciding on such departmental elevations will now be able to avail its post-retirement benefits. "Instructions have been issued to all ministries and departments to give benefit of promotion to those employees who missed it due to late meeting of Departmental Promotion Committee (DPC)," an official in the Department of Personnel and Training (DoPT) said. It would not be in order if eligible employees, who were within the zone of consideration for the relevant year but are not actually in service when the DPC is being held, are not considered while preparing year-wise zone of consideration or panel, as per the DoPT order. Consequently, their juniors are considered (in their place) for promotions, who would not have been in the zone of consideration if the DPC had been held in time, it said. "Appointment Committee of Cabinet has observed that DPCs often do not consider such eligible officers who are retiring before the occurrence of the vacancy in the panel year," the order said, adding that this "undesirable trend negate the very purpose" of government's existing instructions for inclusion of such employees. There have been reports that some of the eligible retired employees are not being given the benefit of promotion which they missed due to late DPCs. In fact the DPCs were being held very late, the official said. The DoPT has asked all central government ministries and departments under it to ensure "strict compliance" of its instructions to include retiring employees for promotions in case the DPCs are delayed. Such retired officials would, however, have no right for actual promotion, the DoPT official said.

CLAIM FOR ACCIDENT

A Motor Accident Claims Tribunal here has awarded over Rs eight lakh to the relatives of a 59- year-old man who died after being hit by a rashly driven motorcycle in August 2011. The tribunal, presided by Sanjeev Kumar Singh, asked The New India Assurance Company Ltd, insurer of the offending motorcycle, to pay Rs 8,07,994 to the family of Delhi resident Dara Singh. “After considering all the documents filed by petitioners as a whole, it is clear that respondent No 1 (driver) was driving the vehicle in a rash and negligent manner,” the tribunal said. “I hereby award a sum of Rs 8,07,994 in favour of the petitioners and against the respondents,” the judge said, while directing the insurance firm to pay the money. According to the family members of the victim, in August 2011 Dara was waiting for a bus near ITO here when a motorcycle, which was being driven in a negligent manner, hit him after jumping the traffic signal. Due to the impact of accident, Dara fell down on the road and received multiple grievous injuries after which he was rushed to a nearby hospital, they said. Dara was discharged from the hospital on the next day but soon he had to be admitted to another hospital due to some complications, the petitioners said, adding Dara died while undergoing treatment there on September 5, 2011. During the adjudication of the petition, the driver of the two wheeler denied that he was riding the motorcycle in a rash and negligent manner.

PROSECUTION FOR FALSE CHARGES

Making a false corruption charge against a public servant proved costly for a man with a Delhi court ordering initiation of legal proceedings against him observing that statements made under oath before it shall be on a “higher pedestal”. Special judge Narottam Kaushal directed initiation of proceedings against Inder Mohan Verma, who had alleged in his complaint that a Delhi Jal Board (DJB) official was seeking a bribe of Rs 600 from him for alloting him water connection. “Either his (Verma) complaint was false or his testimony before the court on oath is false. Statement made under oath before the court shall have to be put on higher pedestal than the signed complaint,” the judge said. “I am thus of the opinion that he has made a false charge against the accused, who is a public servant of having committed the offence punishable under the Prevention of Corruption Act,” the judge said noting that Verma had made a false statement before the court. The court also acquitted DJB official Shiv Kumar against whom Verma had lodged the complaint saying that the complainant has denied that there was demand of bribe and even denied that the complaint was written by him voluntarily. “For the reasons discussed, I am of the opinion that prosecution has failed to prove beyond reasonable doubt that accused Shiv Kumar demanded and accepted bribe from the complainant,” the court said. It said onus is on the prosecution to establish beyond reasonable doubt that there was demand and acceptance of bribe amount by the accused only thereafter the presumption that it was illegal gratification can be drawn. “Accused is entitled to benefit of doubt and is accordingly acquitted,” the court said. According to prosecution, Verma had on October 3, 2011, lodged the complaint before the Anti-Corruption Bureau of Delhi Police alleging that Kumar, who was working in the office of zonal engineer of DJB, demanded money from him for giving the water connection. On his complaint, a trap team was constituted and Kumar was caught while demanding and accepting bribe, it had alleged. During the trial, Kumar had claimed that he was falsely implicated in the case.

PUNISHMENT FOR ABATEMENT FOR SUICIDE

A 62-year-old man has been sentenced to two years imprisonment by a local court for harassing his daughter-in-law and driving her to commit suicide. Assistant Sessions Judge S M Mahadik convicted the accused, Gautam Yedba Kasabe, of Narpoli in Bhiwandi town here, on Saturday under section 306 (abetment of suicide) of the IPC and awarded him two years’ simple imprisonment along with a fine of Rs 2,000. According to prosecution, the victim, 37-year-old Vaishali, was married to Kasabe’s son Dinesh for 11 years and the couple had two children. Kasabe, in an inebriated state, used to frequently abuse, ill-treat and harass her. On June 24, 2013, the accused came home heavily drunk and had a quarrel with Vaishali, who was pregnant at that time. Unable to bear the constant harassment, she set herself on fire when the other family members were asleep. She was rushed to hospital where she succumbed to her burns, the prosecution told the court. Eight witnesses, including the woman’s husband, mother and neighbours deposed in connection with the case. The court relied on deposition of all the witnesses and held the accused guilty.

ONE RANK ONE PENSION

As retried veterans of the armed forces converge on the national capital to protest non-implementation of the “one rank-one pension” (OROP) scheme on Sunday, Defence Minister Manohar Parrikar today said the modalities will be finalised by next week and the file will be sent to the Finance Ministry for further action. Parrikar, while speaking to mediapersons on the sidelines of a defence function, said: “Discussions are on to fix the modalities (for the OROP)… By next week, the view of the Defence Ministry will be formed.” The OROP issue has been fast-tracked, Parrikar said adding he had already held several meetings on it. The scheme was sanctioned by the previous government on February 17 last year. On February 26, the then Defence Minister AK Antony issued executive orders to implement OROP under the “approved” definition at the earliest. Parrikar said as and when the exact implementation status for the scheme is finalised by the Defence Ministry, it will be sent to the Ministry of Finance. Parrikar had in December said if he could take the satisfaction level (of the retired armed forces personnel) to 80-90 per cent, it should be “a good enough solution”. This had not been taken kindly to by the veterans who wanted a clarification on what the 80 per cent satisfaction level meant. The Indian Ex-servicemen Movement (IESM) wanted to know the formula being adopted for OROP saying it would not accept OROP other than the one already accepted by the government. The definition accepted by the Ministry of Defence is the one the Rajya Sabha Petitions Committee chaired by Bhagat Singh Koshyari suggested in December 2011. OROP, it said, “implies that uniform pension be paid to armed forces personnel retiring in the same rank with the same length of service, irrespective of their date of retirement, and any future enhancement in the rates of pension be automatically passed on to the past pensioners.”

Guidelines regarding prevention of sexual harassment of women at the workplace

No. 11013/2/2014-Estt (A-III) Government of India Ministry of Personnel, Public Grievances and Pensions Department of Personnel and Training Establishment Division North Block, New Delhi Dated February 2, 2015 OFFICE MEMORANDUM Subject: Central Civil Services (Conduct) Rules 1964 — Guidelines regarding prevention of sexual harassment of women at the workplace— regarding Following the promulgation of the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013 [SHWW(PPR) Act] and notification of the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Rules, 2013 [SHWW(PPR) Rules] on 09.12.2013., the Government has recently, on 19.11.2014, notified the amendments to Central Civil Services (Conduct) Rules 1964 and Classification, Control and Appeal Rules, 1965. The amendments and other salient features of the Act/ Rules was brought to the notice of all concerned vide Office Memorandum of even no. dated 27.11.2014. The amendments to the Central Civil Services (Conduct) Rules 1964 and Classification, Control and Appeal Rules, 1965 and the Office Memorandum dated 01.12.2014 are available on the Department’s website. 2. The following guidelines, conveying the decision of the Committee of Secretaries on this subject, were issued vide this Department’s Office Memorandum No. 11013/3/2009-Estt.(A) dated 03.08.2009, “As regards provisions for protection of women, it was suggested that the complaints committee mechanism provided under Vishakha guidelines relating to sexual harassment should be strictly in accordance with the judgment and steps should be taken to ensure that the committee is effective and functional at all times. It would also be desirable for the Committees to meet once a quarter, even if there is no live case, and review preparedness to fulfil all requirements of the Vishakha judgment in the Department/Ministry/ organization concerned.” 3. As per the guidelines issued vide Office Memorandum dated 21.07.2009, it is also to be ensured that the Complaints Committee shall at all times be in existence and changes in its composition, whenever necessary, should be made promptly and adequately publicized. The composition of the Complaints Committee should also be posted on the websites of the concerned Ministries/Departments/Offices concerned. 4. Vide the Office Memorandum dated 01.12.2014, the attention of the Ministries/Departments was also invited to the reporting requirements mentioned in the SHWW(PPR) Act and SHWW(PPR) Rules. 5. All Ministries/ Departments are requested to please review the progress of implementation of the existing abovementioned guidelines issued in the aftermath of the Vishakha judgment. 6. Attention of all Ministries is invited to Section 22 of the Act relating to including information in Annual Report, and to request that information relating to number of cases filed, if any, and their disposal may be included in the Annual Report of the Ministry / Department. 7. SERVICE MATTER IMPORTANT JUDGMENT

1. Maj Gen HM Singh, VSM v. Union of India and ANR. [Civil appeal no. 192 of 2014 (arising of SLP (c ) no. 2008 of 2010)] Service Law- Eligible candidates have a fundamental right to be considered for promotion against the vacancy and promoted if suitable- Facts are that whether the non-consideration of Maj Gen Singh’s claim would “violate the fundamental rights vested in him under Articles 14 and 16 of the Constitution of India”. Answering its query in affirmative, with a rider that it was subject to authorities being desirous of filling the vacancy of a Lt Gen’s post when it became available on Jan 1, 2007, the court said that in the case of Maj Gen Singh, the authorities were desirous of filling up the said vacancy in the Defence Research and Development Organisation (DRDO). The court rejected the government’s plea that at the time of considering Maj.Gen. Singh for promotion, he was on extension of service. Granting promotion to Maj Gen Singh as Lt. Gen. from the date due to him, the court said that he would be treated as being on service till Feb 28, 2009 when he would have attained the age of 60 years, and would be entitled to “all monetary benefits which would have been due to him, on account of his promotion to the rank of Lt Gen till his retirement on superannuation, as also, to revised retirement benefits which would have accrued to him on account of such promotion”.-The court also directed the government to release the monetary benefits to Maj Gen Singh within three months from the date of the receipt of the certified copy of its judgment. 2. Cheel Singh v. MGB Gramin Bank Pali & Ors. [ Civil appeal no. 6018 of 2014 (arsing out of SLP © no. 29807 of 2012)] Service Law- Unauthorised absence on medical negligence- Facts are such that the present appellant working with respondent bank as a clerk-cum-cashier was on leave without prior permission or medical certificate for 10 and half months. Post which he submitted his medical certificate stating his serious illness- Disciplinary authority dismissed the Appellant from his services- Single bench High Court quashed the order of dismissal and ordered re-in statement- division bench in appeal in part allowed the decision of the single bench high court, but quashed the order of reinstatement- Held, the Appellant had submitted his medical certificate, and no where was the validity of the certificate questioned, if the same is believed to be true the Appellant could not have been dismissed – Appeal allowed. 3. Director General ESIC & Anr. Puroshottam Malani [ civil appeal no. 4611 of 2008 (Arising out of SLP (c) no. 1551 of 2007)] Service Law- Withdrawal of voluntary retirement- In the present case the respondent working as a manager gave a voluntary retirement with a three months notice- withdrew the notice prior to last day of reliever- the authorities rejected his withdrawal of voluntary retirement- the High Court reversed the order and ordered the withdrawal of voluntary retirement should have been accepted- Held, that the general rule is in case the employee withdraws the voluntary retirement the same is to be entertained when given along with reasons, In this case no reasons were given secondly the respondent had received the benefits of pension etc. and had en-cashed the same – Employment with the government is not a contract and in this case without any valid reason for withdrawal the same could not have been accepted. Order of High Court quashed. 4. Rohtas Bhankhar & Others v. Union of India [Civil appeal no. 6046- 6047 of 2004] Service law- Regarding lowering of qualifying marks lowering the standard for evaluation for SC/ST candidates for reservation in promotion to be declared as legal- Held, that the principle of allowing lowering of qualifying marks for SC/ST candidates is is a sound principle and the same not be changed- Results of the candidates be calculated again after allowing them the benefit. 5. V.S Ram v. Bangalore Metropolitan Transport Corpn. [Civil Appeal no. 412 of 2015 (arising out of SLP (c) no. 5236/ 2014] Service Law- Once the labour court has exercised its discretion judiciously the High court can interfere with the award only if it is satisfied that the award of the labour court has any fundamental flaw- Appellant driver was charged with misconduct for false transfer certificate after 5 years of service- Enquiry was held and the Appellant was found guilty- dismissed from service- Labour court ordered the re-instatement of the Appellant- High court reversed the order of the Labour Court- Held, that the order of the Labour court was sound and judicious and the High Court should avoid interference with the award of the labour court – Ordered re-instatment of the appellant as he was of 45 years of age and could not have looked for alternative employment also that a time of 14 years had lapsed while the enquiry was being conducted and lastly on the ground that other employees with similar misconduct were given punishment of a lesser degree.

Major setback for private developers in Noida and Greater Noida areas after SC upholds Allahabad High Court order

In what could be termed as a big relief for farmers based in the Noida and Greater Noida regions, the Supreme Court on Tuesday upheld the Allahabad High Court’s order that asked the government authorities to pay 64.7 per cent additional compensation to all those whose land was acquired. The SC ruling on the matter can be seen as a massive setback for private developers in the region. In an earlier verdict, the Allahabad High Court had cancelled the acquisition of land in three villages and instructed the government authorities to pay higher compensations in addition to 10 per cent of developed land in 60 other villages that fall within the vicinity of the farmers. The HC order was challenges in the apex court by both Noida and Greater Noida authorities. More than 1000 petitions filed but the authorities were rejected by a bench led by Chief Justice HL Dattu while hearing the case. The Noida and Greater Noida authorities had demanded in their petition that the developed land to be awarded to the farmers should be lowered to 5 per cent in Noida and 6 per cent in Greater Noida. In October 2011, the High Court adjudicated a case that saw farmers alleging that their land had been acquired forcibly by the Uttar Pradesh government using the “urgency clause”. However, instead of granting the acquired land to industries, the government gave away the land to private builders without even paying any fair compensation to the farmers. Farmers numbering as many as 491 from 61 different villages in the Gautam Budh Nagar district approached the judiciary challenging the acquisition of over 3,000 hectares of land by government agencies.

Husband and Wife must file affidavits detailing income, assets, and expenditures during divorce proceedings

The Delhi High Court has ruled that during divorce proceedings, both the husband and the wife need to submit detailed affidavits of their earnings, assets, and expenses at the time of filing divorce or maintenance petitions. With this ruling, any attempt to hide assets or income details at the time of divorce or maintenance proceedings could push one into legal complications and great difficulties. Justice J R Midha directed that, “the detailed affidavit, along with copies of relevant documents, have to be submitted by both parties at the time of divorce proceedings so that maintenance orders can be passed by courts within 60 days of the divorce being initiated on the basis of “true income”. The court held that, “Maintenance is not merely a legal right, it is part and parcel of basic human rights. For weaker sections, it is a problem in the sense that their very survival rests on the maintenance,” the court stated, adding that “lengthy trial in matrimonial proceedings is uncalled for and contrary to the spirit of the Hindu Marriage Act”. The court asked Additional Solicitor General Sanjay Jain to take up the issue with the law ministry so as to ensure that relevant legal provisions can be amended. When completed, this would pave the way for the new provision requiring mandatory affidavits. The HC also asked all family courts to make sure that the affidavits are properly filled. It said that these directions were “necessitated because the parties in the matrimonial litigation do not disclose their true income and the claims of maintenance are dragged up to two years and the court, finding it difficult to determine the true income, tends to fix maintenance by drawing presumptions”. The court issued another directive adding that, “the aforesaid procedure be followed in all cases relating to maintenance, including cases under the Hindu Marriage Act, 1955, Protection of Women from Domestic Violence Act, 2005, Hindu Adoption and Maintenance Act, 1956, Special Marriage Act, 1954, The Indian Divorce Act, 1869 as well as Section 125 CrPC”.
